Please read these Terms of Use of the B50 Community Website (the “Terms”) carefully before using the B50 Community Website or making charitable contributions to the B50 Community online through such website (the “Website”). These Terms contain important information about your rights and obligations.

By using the Website where these Terms are posted, you confirm that you have read the Terms, understand their content and undertake to comply with them in full. If you do not agree to these Terms, please do not use this Site.

The terms B50, B50 community mean the B50 Volunteer Community, which includes the CO “CF “B50 VOLUNTEERS” and public organization B50, non-profit organizations registered in accordance with the current legislation of Ukraine, information about which and their data and details can be found in the relevant section of the Website.

The collection and use of personal data in connection with your use of the Website is carried out in accordance with our Privacy Policy.

Full agreement

Short version: These Terms are an agreement between us and our users. By using this Site, you agree to be bound by these Terms and all applicable laws and regulations and represent that you have the legal capacity to do so.

These Terms and any policies posted on the Website, including our Privacy Policy, constitute the entire legally binding agreement between you (“you” or “user”) and B50 community governing your use of the Website and your charitable fundraising through the Website.

By using the Website, you represent and warrant that:

  • you have the legal capacity and authority to enter into this agreement under the laws of your country;
  • the laws of your country do not restrict your use of the Website;
  • you are in compliance with these Terms and the relevant legal requirements.

Areas of activity of B50 community

Short version: The B50 community website is intended for users who wish to make a charitable contribution or otherwise help the community.

Since 2022, B50 community has been regularly helping Ukrainian citizens overcome the consequences of the armed aggression of the terrorist country of the russian federation. The community does not belong to any political party, commercial organization or influential person and is funded by charitable contributions from individuals and legal entities. All community documents, as well as financial and project reports, are available on our website in the relevant sections.

B50 community websites are a tool for obtaining information about the current activities of the community and for carrying out charitable activities under the following programs:

  • Restoration,
  • Growing,
  • Care
  • Country of Volunteers

The Website is intended for users who wish to make a charitable contribution (“Donors”) or otherwise help the community (“Volunteers”), as well as Ukrainian citizens in need of assistance (“Beneficiaries”).

Support

Short version: You can make one-time and monthly charitable payments to the community through the Website. The funds received by the community are used to help Ukrainian citizens in need (“Beneficiaries”).

Through the Website, users can make charitable contributions to the community, which uses them in the above-mentioned areas. You can also make a one-time donation.

B50 does not conduct targeted fundraising, instead, the community purchases materials and products at the request of recipients of assistance, tools for volunteering under current community programs, and pays for the costs of providing services to individuals and legal entities with whom an agreement of cooperation is signed. 

Reports on the use of charitable contributions are prepared periodically and published here. In addition, a report on the use of income (profits) of a non-profit organization is submitted annually to the tax inspection, and the reports are also available on our Site.

Please note that payments through our Site are provided by payment service providers that we do not control, namely LiqPay. Once you click on the payment link, you must comply with the terms of use, privacy policy and other policies of such providers. B50 is not responsible for the payment data processed by such providers.

Please note that we do not control the exchange rate and fees that may be applied by the bank.

Help needed

Citizens of Ukraine and other persons in need of assistance in overcoming the consequences of the armed aggression of the terrorist country of the russian federation can apply for assistance from B50.

Please note that B50 provides assistance to Ukrainian citizens living in regions that are in the zone of hostilities and/or occupation, as well as to Ukrainian citizens living in any region of Ukraine who have documented evidence of damage and/or full or partial destruction of real estate as a result of air or missile attacks.

B50 does not guarantee that you will receive the necessary assistance in full and within the specified timeframe, as it depends on the charitable contributions provided by the Donors and the queue of Beneficiaries applying for assistance.

Volunteers

If you would like to help beneficiaries with your knowledge, skills or time, you can become a B50 volunteer.

We invite you to help not only with money, but also with volunteering. Today, more than 100 regular volunteers are helping Ukrainian citizens in difficult life circumstances due to the military aggression of the terrorist country of the russian federation: IT professionals, actors, photographers, designers, lawyers, translators, hairdressers, and many other people of different professions.

To become a B50 volunteer, please follow this link. Our coordinator will contact you using the contact information provided and tell you how and when you can help B50 in its charitable activities. First of all, B50 staff will provide you with an introductory briefing and, if necessary, additional training.

Upon your request, B50 will sign a corresponding volunteer agreement.

If you are under 18, you can also become a B50 volunteer. To do so, your parents/legal guardians must provide us with written consent for your volunteer work for B50.

Third-party services and websites

When you use sites and services that we do not control, you must comply with different terms of use and privacy policies.

Some functions of the Website (for example, making a charitable payment) involve the use of third-party services and websites that B50 does not control.

In case of problems, we will make every effort to resolve them. However, we are not responsible for the content and functionality that may be offered on such sites or by such third-party services, nor for any loss, damage or other liability arising from your use of such third-party sites or services.

Please note that different terms of use and privacy policies apply to your use of third-party sites and services. In no event shall B50 be responsible for any personal data processed by third-party websites and services.

Content and intellectual property

Short version: B50 owns the Website and all its content. We grant you certain rights to use the Website and the content to the extent provided for in these Terms.

The Website is owned and controlled by B50. All materials on the Website, including texts, images, designs, graphics, information, logos, audio and video recordings, interfaces, software, trademarks, trade names (the “Content”), as well as copyright and other intellectual property rights in such Content, are owned by B50, namely CO “CF “B50 VOLUNTEERS” or public organization B50, or posted with the consent of the owner.

The Content and any of its elements may not be used without the prior written permission of B50 or the respective owners in any way not provided for in these Terms.

Subject to your compliance with these Terms, B50 grants you a limited, non-exclusive, revocable, non-sublicensable, non-transferable license to:

  • use of the Website from your personal devices on the terms and conditions provided for herein

  • access and view any Content posted on or through the Website, in particular for your personal non-commercial use.

By downloading or making copies of the Content, you do not obtain any rights to such Content. You may not reproduce, publish, transmit, distribute, modify, create derivative works from, or otherwise exploit the Content for any commercial or unlawful purpose without our prior written permission. You agree not to alter or remove any proprietary notices from materials downloaded or printed from the Website.

B50 may modify the terms or revoke this license or terminate your access to the Content at any time and for any reason without prior notice. Please note that B50 will enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution for serious offenses.

Disclaimer of warranties and limitations of liability

Short version: Our Site is provided on an “as is” basis and we make no promises or warranties of any kind regarding its operation. We will not be liable for any loss or damage caused by your use of or inability to use the Website or otherwise arising under this agreement.

B50 Website is provided on an “as is” basis. Unless otherwise expressly provided in these Terms or other policies on the Website, B50 disclaims all warranties to the maximum extent permitted by law with respect to the Website, its functionality and Content.

B50 is responsible for the use of charitable contributions in accordance with the current legislation of Ukraine.

However, we do not make any promises or guarantees, in particular, regarding the accuracy, usefulness, reliability and correctness of the Website. B50 does not warrant that the operation of the Website will be uninterrupted or secure, that any defects will be corrected, or that the Website is free of viruses or other harmful elements.

B50 shall not be liable if any information, materials, Content available on the Website are inaccurate or incomplete, as well as for typographical errors or defects in the text or other materials.

In no event shall B50, its founders, members, employees, contractors or volunteers be liable for any direct, indirect, incidental, special, exemplary or consequential damages related to the use or inability to use the Website, including, without limitation, any damages resulting from errors, omissions, interruptions, defects, viruses, even if B50 has been advised of the possibility of such damages.

The foregoing disclaimers and limitations of liability shall apply to the maximum extent permitted by applicable law.

Compensation for damages

Short version: You are responsible for your use of the Website. If you cause harm to someone else or get into a dispute, we will not be involved in resolving it.

To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold B50, our partners, employees, contractors and volunteers harmless from and against any and all claims, liabilities, damages, losses and expenses, including reasonable legal and accounting fees, in any way related to or arising out of 

i) your breach of any of the provisions of these Terms,

ii) your use/improper use of the Website, Content, functions available on the Website,

iii) your violation of laws or rights of third parties.

You also agree to indemnify B50 for any losses and expenses incurred by B50 (including fees or expenses of attorneys, accountants, professional advisors and other experts) in connection with the defense or settlement of disputes arising from your use of the Website for any unlawful or prohibited purpose.

We reserve the right to pursue such remedies as we deem appropriate, including in cases where you release us from liability. You therefore agree to cooperate with us in implementing our strategy to protect your rights.

Applicable law and dispute resolution

Short version: This agreement is governed by the laws of Ukraine. We hope to resolve all issues amicably, but in the event that a serious dispute arises between us, it must be resolved in a court of law in Ukraine.

Except as otherwise provided in these Terms or any other policies, these Terms are written and interpreted in accordance with the laws of Ukraine.

If any material on the Website or your use of the Website is contrary to the laws of your location, the Website is not intended for you and we ask you not to use it. You are responsible for familiarizing yourself with and complying with the laws of your jurisdiction.

Any dispute, conflict, claim or controversy directly or indirectly related to the Website or these Terms, including their validity, interpretation or application, shall be resolved through amicable negotiations directly with the B50 team in accordance with the principles of good faith and cooperation. If no consensus can be reached through negotiations, the dispute shall be resolved exclusively in the courts of Ukraine, subject to the rules of jurisdiction, in accordance with the applicable substantive law of Ukraine.

All claims must be filed within one (1) year from the date of their occurrence, unless a longer period is required by applicable law.

Electronic communications

By providing us with your email address through the Website, you understand and agree that we may send you messages to the contact information you provide, including

i) notifications of updates to the Website;

ii) information or materials related to your use of the Website, making charitable contributions and their use;

ііі) information about updates to these Terms.

You have the opportunity to opt out of receiving emails from us by following the instructions provided in such messages.

Other terms and conditions

If any provision of these Terms is found to be illegal, invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

We may transfer our rights and obligations under these Terms to a third party, but this will not affect your rights or our obligations under this Agreement.

A printed version of these Terms is admissible as evidence in any judicial or administrative proceedings arising out of or in connection with the use of the Website to the same extent and under the same conditions as other business documents and records created and maintained in printed form.

We reserve the right to make changes to these Terms at any time. In the event of a material change that may affect your use of the Website or your rights as a user of the Website, we will notify you of such changes within a reasonable time before they become effective by posting a notice on the Website or sending you an email.
